These Terms of Service and End‑User Licence Agreement (collectively, the “Terms”) govern your access to and use of mobile games, applications, websites and related services (the “Services”) published by Mageeks (a brand of Consulit s.c.), operated from Warsaw, Poland, EU (“Mageeks”, “we”, “us”, “our”). By downloading, installing, accessing or using any of the Services you agree to be bound by these Terms. If you do not accept them, do not use the Services.

1. Definitions

  • Games – all current and future Mageeks titles, including but not limited to Bus Simulator PRO: Urban Rivals, Construction Simulator PRO, Truck Simulator PRO USA, Truck Simulator PRO Europe and Train Simulator PRO USA.
  • Platforms – distribution stores and operating systems where Games are offered (Apple App Store, Google Play, Amazon Appstore, Epic Games Store for Android, etc.).
  • Content – all graphics, text, software, data and other materials included in or made available via the Services.
  • User Content – any content submitted, posted or otherwise transmitted by users within the Services, including chat, forum, Discord or social‑media posts linked to the Games.

2. Licence Grant

Mageeks grants you a personal, non‑exclusive, non‑transferable, revocable, limited licence to download and use each Game on a device you own or control, strictly in accordance with these Terms and any Platform rules.

2.1 Unreal Engine & Unity

Some Games are developed using Unreal® Engine (Epic Games, Inc.) and/or Unity® (Unity Technologies A/S). Mageeks, not Epic Games or Unity, is solely responsible for the Games and their Content.

UNREAL ENGINE DISCLAIMER. Unreal Engine is supplied by Epic Games, Inc. “as is” and “as available” without any warranties, conditions or representations of any kind. Epic Games, its affiliates, licensors and service providers disclaim all warranties and liabilities, express or implied, relating to Unreal Engine and will have no liability for any damages arising from or relating to your use of Unreal Engine within the Games.

3. Accounts & Log‑in Services

Some features (e.g., cloud saves, leaderboards) may require you to authenticate through third‑party log‑in services such as Apple Game Center, Google Play Games, Facebook Login, or Epic Account Services. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

4. In‑App Purchases & Subscriptions

Games may offer optional paid content, virtual currency, time‑limited passes or auto‑renewable subscriptions (“IAPs”). Prices, terms and renewal periods are displayed in‑game and on the relevant Platform. ALL SALES ARE FINAL AND NON‑REFUNDABLE except where required by applicable consumer law or Platform policy. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in the Platform’s subscription settings.

5. Advertising, Analytics & Third‑Party Services

We may display ads or measure usage through mediation and analytics partners including, without limitation, mediation platforms such as AppLovin MAX or Google AdMob and analytics providers such as ByteBrew, Firebase, Facebook Analytics and Kochava. Partner lists may change over time; an up‑to‑date overview is kept in our Privacy Policy. Ads may be targeted based on device identifiers and consent settings you provide through Platform privacy controls (e.g., App Tracking Transparency on iOS).

6. User Conduct

You agree not to:

  1. Use the Services for any commercial purpose except as expressly permitted by Mageeks.
  2. Cheat, exploit, automate, or modify any Game or interfere with other players.
  3. Upload or transmit User Content that is illegal, harassing, hateful, obscene, infringing or otherwise objectionable.
  4. Reverse‑engineer, decompile or extract source code except as permitted by law.

Mageeks reserves the right to remove User Content, suspend accounts or take other action at its sole discretion.

7. Intellectual Property

All Content is owned by Mageeks or its licensors. Except for the limited licence in Section 2, no intellectual‑property rights are transferred to you. “Mageeks” and related logos are trademarks of Consulit s.c. All other trademarks are property of their respective owners.

8. Updates & Availability

Games may automatically download and install patches or updates. Mageeks is not obligated to continue supporting any Game or to make specific Content available for any minimum period.

9. Disclaimer of Warranties

To the maximum extent allowed by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, uninterrupted availability, or non‑infringement.

10. Limitation of Liability

Mageeks, its directors, employees or partners will not be liable for indirect, incidental, special, punitive or consequential damages (including loss of data, goodwill or profits) arising from your use of the Services. Our aggregate liability will not exceed (a) the total amount you paid to Mageeks in the 12 months preceding the claim, or (b) one hundred (100) euro, whichever is greater. Nothing excludes liability for death, personal injury or intentional misconduct where such liability cannot be excluded under applicable law.

11. Termination

These Terms remain in effect until terminated by you or Mageeks. You may terminate by deleting all Games and associated data. Mageeks may terminate or suspend access at any time for breach of these Terms or where required by law. Upon termination, all licences granted to you cease immediately.

12. Governing Law & Consumer Rights

These Terms are governed by the laws of Poland and applicable EU consumer protection regulations, without regard to conflict‑of‑law provisions. If you reside in the EEA or UK, you also enjoy mandatory consumer rights under your local law. You may bring disputes to the competent Polish courts or any court that mandatory law allows.

13. Changes to Terms

We may revise these Terms from time to time. The latest version will be posted on our websites and, where material, notified in‑app or via Platform update notes. Continued use after the effective date constitutes acceptance of the revised Terms.
